TERMS AND CONDITIONS
1. Application of Terms
These Terms apply to all orders placed via our website or directly with us.
Where a customer is acting as a consumer, statutory rights under applicable law apply, including the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013.
Where a customer is acting in the course of business, additional B2B terms apply as set out below.
Nothing in these Terms affects statutory rights that cannot be excluded by law.
2. Privacy Policy
Please refer to our Privacy Policy for details of how we collect and process your data. By using this website, you confirm that all information provided is accurate and consent to such processing.
3. Prices
All prices are exclusive of VAT and carriage unless otherwise stated.
We reserve the right to amend prices, specifications, and availability without notice due to fluctuations in raw materials, labour, or supply chain conditions.
Quotations are valid for 30 days unless otherwise confirmed in writing.
4. Orders and Specifications
All goods are manufactured to order based on customer specifications.
By placing an order, the customer confirms that all details provided are accurate and complete.
We accept no liability for errors arising from incorrect specifications supplied by the customer.
Once production has commenced, orders cannot be amended or cancelled without our written agreement and may incur charges for work completed
All goods are manufactured to order and non-returnable.
5. Manufacturing & Lead Times
Any lead times or delivery dates are estimates only.
We will use reasonable efforts to meet stated timescales but shall not be liable for delays caused by, including but not limited to:
• Material shortages
• Supply chain disruption
• Equipment failure
• Labour issues
• Courier delays
• Force majeure events
Time shall not be of the essence.
6. Delivery & Risk
6.1 General
Delivery charges are calculated at checkout based on weight and destination.
All deliveries are made via third-party couriers.
6.2 B2B Customers
We shall not be liable for any loss, cost, or damage arising from late delivery or failure to deliver.
6.3 B2C Customers
We will deliver goods within a reasonable time and in any event within 30 days unless otherwise agreed, in line with the Consumer Contracts Regulations 2013.
6.4 Risk
Risk passes on delivery (or attempted delivery).
For consumers, risk passes when goods come into physical possession of the customer or nominated recipient.
7. Inspection of Goods
Goods must be inspected upon delivery.
Any visible damage must be noted at the time of delivery and reported within 48 hours.
Failure to notify may affect claims against carriers.
8. Returns, Cancellations & Faulty Goods
8.1 Made-to-Order Goods
All goods are manufactured to the customer’s specification.
Under the Consumer Contracts Regulations 2013, the statutory cancellation right does not apply to personalised or made-to-order goods.
Accordingly:
• Orders cannot be cancelled once production has begun
• We are not required to accept returns for change of mind
• Any pre-production cancellation is discretionary and may incur costs
8.2 Consumer Statutory Rights
Nothing in these Terms affects your rights under the Consumer Rights Act 2015.
Consumers are entitled to remedies if goods are:
• Faulty
• Not as described
• Not fit for purpose
Where confirmed, we will (at our discretion):
• Repair
• Replace
• Refund
This is the consumer’s sole remedy.
8.3 Business Customers
Goods are sold strictly on a non-returnable basis unless agreed in writing.
9. Limitation of Liability
9.1 B2B Customers
We shall not be liable for:
• Loss of profit
• Loss of business
• Indirect or consequential loss
• Delay or failure to deliver
Total liability is limited to the value of the goods supplied.
9.2 Consumers
We do not exclude liability for:
• Death or personal injury caused by negligence
• Fraud
• Any liability that cannot legally be excluded under the Consumer Rights Act 2015
10. Payment Terms
Payment must be made in full before production unless agreed otherwise.
We reserve the right to suspend or cancel production where payment is not received.
Accepted methods:
• Card (secure third-party processing)
• PayPal
• BACS / Cheque
• Approved Purchase Orders (public sector only, 30 days)
11. Retention of Title (Ownership)
11.1 Business Customers
Title remains with us until full payment is received.
We reserve the right to recover goods where payment is overdue.
Goods may be resold in the normal course of business, but proceeds shall be held on trust until payment is made.
11.2 Consumers
Ownership transfers on full payment and delivery of goods.
We reserve the right to recover unpaid goods where legally permitted.
12. Force Majeure
We shall not be liable for failure or delay caused by events beyond our reasonable control, including:
• Supplier failure
• Transport disruption
• Material shortages
• Industrial action
• Natural disasters
13. Intellectual Property
All designs, images, and content remain our intellectual property.
Customers warrant that any materials supplied do not infringe third-party rights and agree to indemnify us against related claims.
14. VAT
All prices are subject to VAT at the applicable rate.
15. General
If any provision is found invalid, the remainder shall remain in full force.
